General Litigation

Ken Lynch and Stephanie Krafchak have experience in general litigation matters including, but not limited to, defensive matters involving fraud, real estate and general tort claims. Tort claims are civil claims (as opposed to criminal) for which damages are available as compensation.

Stephanie Krafchak and Ken Lynch has experience in a wide range of matters related to business and financial institutions with regard to real estate matters; disputes between partners and joint venturers; lender liability defense; fraud, including fraud arising from real estate transactions; unfair business practices; and collections.

Bankruptcy and Insolvency
Ken Lynch and Stephanie Krafchak have represented numerous clients in Chapter 7 and Chapter 13 proceedings. To Both have experience in representing creditors in major bankruptcy proceedings, including; relief from stay litigation; complaints to determine the dischargeability of debt; negotiation of plans of reorganization; issues concerning use of cash collateral; valuation hearings; preferential transfer litigation; and avoidance and fraudulent transfer litigation. Both have significant experience in representing creditors in negotiating pre-bankruptcy workouts and consensual plans or reorganization. Another aspect of their experience involves the appointment of state court receivers to collect rents, perfect the creditor's interest in rents and revenues prior to bankruptcy and other types of issues involving accounts receivable and inventory.
Ken Lynch and Stephanie Krafchak have experience in secured and unsecured loan documentation, security agreements, intercreditor agreements and real estate leasing.

We believe in practicing in a manner that obtains the best result for the lowest reasonable cost. Depending upon what the client wishes to accomplish, a case can be handled on a low-budget approach or a sophisticated no-holds-barred attack, involving complex legal issues. In some situations, clients are offered flat contingency arrangements, as well as, the traditional hourly rates for non-standard complex litigation.


For those matters handled on an hourly basis, clients are provided detailed billing based upon time increments of six minutes. Krafchak & Lynch believes a client has an absolute right to receive a detailed explanation for the time spent their cases and billings reflect that belief. When a client receives a bill there should be no question as to what was done to generate that bill.
